Procedures & Fees

No cases may be taken involving any policyholders, shareholders, officers or directors of Founders Insurance Company, Founders Insurance Company of Michigan, Graphic Arts Mutual Insurance Company, Republic Franklin Insurance Company, Utica Lloyds of Texas, Utica Mutual Insurance Company, Utica National Insurance Company, Utica National Insurance company of Ohio, Utica National Insurance Company of Texas, and Utica Specialty Risk Insurance Company.

All mediations shall be conducted over Zoom, unless all sides agree to do it in person, to be held at an agreed upon location. For any mediation taking place outside of the Utica/Rome area, the parties shall reimburse the mediator for any associated travel expenses.

A deposit must be paid at least 2 weeks prior to the mediation to secure the date and to compensate the mediator for his preparation time. The remaining amount must be paid at least 2 days before the mediation, or else the date may be cancelled/rescheduled.

Each party must execute the Mediation Agreement and submit it to Legendary Mediations prior to the commencement of the mediation.

Counsel for each party must submit copies of the relevant pleadings and Bill of Particulars etc if the matter is in court, as well as a detailed position statement at least 2 weeks before the scheduled mediation.

Counsel must also engage in a pre-mediation contact or phone call with the mediator at least 1 week before the mediation.

All fees/expenses may be divided as the parties may agree, however absent any agreement, fees/expenses will be split evenly between them.

The deposit is non-refundable. The remaining fee paid for the mediation itself may be refunded upon 24 hours’ notice prior to the start of the mediation.
